Term and conditions for service usage

HellShare offers its users the chance to share data on the internet with other users. You can upload files of up to 1,000 MB to HellShare and offer them for downloading to other internet users through a link.

When providing information for transfer or storage, a user of the HellShare service (hereinafter the "service") shall act in accordance with valid legislation and shall comply with the terms, conditions and rules specified below:

• A user may not transfer or store information whose disclosure to another person would be a criminal offence, misdemeanour or any other unlawful conduct prohibited by the legal order of the Czech Republic and/or the law of the European Communities or the European Union
• In particular, a user may not prohibit any criminal activity, encourage its commission, approve it, or promise help to those engaged in criminal activity
• A user is further prohibited, in particular, from in any way interfering with the copyrights of other persons and other intellectual property rights
• If a service user resides in another country, he is prohibited from engaging in any unlawful conduct that is in conflict with the legal order of the Czech Republic and/or the law of the European Communities and European Union and/or the legal order of the country in whose territory he resides when using the service specified above
• The user takes note that he shall reimburse the service provider or other persons for all damage and detriment he causes to them when using this service
• The user takes note that the provider is not under a duty to supervise the content of transferred or stored information under Section 6 of Act No. 480/2004 Coll. on some information society services (as amended)
• The user takes note that the provider is not under a duty to actively search for facts and circumtances indicating unlawful content of the transferred and stored information under Section 6 of Act No. 480/2004 Coll., on some information society services (as amended)
• In the event that the user gives an e-mail address, he shall give his actual e-mail address. He may receive information concerning the service at this e-mail address at any time.
• The service provider is entitled to delete any file without giving reasons
• The respecting of all the aforementioned rules by the user when using the service shall be regarded as a necessary condition for the authorised use of the services and any breach of the aforementioned rules by the user when using the service shall be regarded as unauthorised.
• Any attempt to damage the service's functionality will be prosecuted and compensation for damage arising will be claimed from such person
• In the event you have reason to believe that any service user is breaching your copyright, or is using the service to disseminate unlawful content, please send us an e-mail to hellen@hellshare.com containing at least the following basic information:
  • Your name, address and, if appropriate, telephone number
  • Please give an e-mail address at which we can contact you
  • Specification of the defective content, in the event of unlawful content, please describe the defective content.
  • Please give a precise link (if there is more than one, then all of them) to the defective content.
